1. 2. Use of the Website: Any user can access the Website and its contents freely and free of charge, such access and use being subject to these terms of use.

The user must be over 18 years of age and have sufficient legal capacity to be bound by these terms, expressly accepting without exception that access to and use of the Website, its services and contents is under his/her sole and exclusive responsibility.

If the user does not agree with the content of these terms of use, he/she must leave the Website and may not use the services and/or contents offered therein.

The user undertakes to make appropriate use of the website resources, in accordance with the provisions of these terms, morality, public order, good customs and current legislation, without harming or damaging the owners of the website or any third party, and therefore undertakes not to use the contents and/or services offered on the website to engage in illicit or illegal activities or activities contrary to good faith and public order; disseminate content or propaganda of a racist, xenophobic or pornographic nature, or that advocates terrorism or violates human rights; cause damage to the physical and logical systems of ANALCO, its suppliers or third parties, introduce or disseminate computer viruses or any other physical or logical systems that may be susceptible to causing the aforementioned damage.

2.1. Publication of content. Assignment of rights:

The registered user who inserts or publishes content on the Website through the blog comments form, dare to give your opinion form and any other participation system that exists or may exist, must hold the legitimate ownership of the intellectual and industrial property rights or any other rights over the same in order to reproduce, distribute and communicate them publicly through any electronic media, with the use of such content by the user entailing their declaration that they hold the legitimate and sufficient rights for the insertion or use of the same.

It is the user’s obligation to obtain any type of authorisation, permission or licence, if necessary, for the insertion or publication of any content on the Website and declares that by the mere fact of publishing such content, he/she has such authorisations, permissions or licences.

It is strictly forbidden to insert content that is allegedly illegal by national, community or international regulations or which contravenes the principles of good faith or which, by way of example, but not limited to: are libellous or slanderous, violate the laws for the protection of minors, any third party rights, favour or cooperate with pornography businesses, are obscene materials, manage erotic contacts, are related to gambling, clairvoyant services, or which may be violent, linked to pyramid businesses, and in general any content that ANALCO considers inappropriate for the purpose of the Web and especially for minors.

ANALCO reserves the right to remove any content deemed inappropriate for the characteristics and purposes of the website.

Insofar as ANALCO cannot control each and every one of the publications made by users, it may not assume responsibility for such content, unless it has actual knowledge of the insertion of content considered inappropriate in accordance with these terms of use, such as, but not limited to, those listed below: contents in any of their expressions that violate the law, respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that threaten youth or childhood, public order or safety, etc.

In any case, users who upload content shall be solely responsible for any damage or harm or consequence that may be caused or produced as a result of the use of such content, and ANALCO shall be exonerated from any liability whatsoever.

3. Exclusion of guarantees and liability for the operation of the Website:

ANALCO shall under no circumstances be liable for any lack of operability or occasional and/or temporary unavailability of the Web for reasons not attributable to it; for any damages that may arise from such lack of operability and/or availability, without prejudice to the fact that ANALCO shall do everything possible to guarantee the availability and operability of the service; for any errors or security deficiencies that may arise from the use by the user of an out-of-date or insecure version of a browser, as well as for any other cause attributable solely to the user.

ANALCO neither assumes nor identifies itself with the opinions, comments or actions of users on the Website, nor does it hold any editorial activity in this area. Users (and their legal representatives) shall be solely responsible for such opinions, comments or actions.

ANALCO, despite the many prohibitions, rules and recommendations that it addresses to users of the Platform, does not guarantee, nor is it responsible in any way for their use of the Platform in a manner that is consistent, diligent and/or appropriate with these terms of use and the privacy policy. However, it may implement security and detection systems in this area and shall adopt all the necessary corrective measures as soon as it has reliable knowledge of possible breaches in this respect, ensuring the general legitimacy of the services, content, images and comments that may be posted on the Website without this representing any obligation of control on the part of ANALCO. 4. Intellectual and Industrial Property: ANALCO holds all rights over the design and source code of the Web, as well as over the contents thereof: images, photographs, texts, logos, designs, trademarks, trade names, data included on the Web, menu layouts, graphics, colours, tools, etc.

All software used for the development of the Website is the property of ANALCO or its suppliers.

All the aforementioned is therefore protected by intellectual and industrial property legislation.

The total or partial, direct or indirect reproduction, in any medium or format without the authorisation of ANALCO of the website and any of its contents is expressly prohibited, as is the adaptation, modification, distribution, commercialisation, public communication, making available or any other conduct infringing current legislation on intellectual and industrial property.

In the event that any user or third party considers that their legitimate rights have been infringed by the introduction of certain content on the Web Site, they may notify ANALCO of this circumstance by e-mail to the address analco@analco.com, providing the personal details of the interested party who is the owner of the allegedly infringed rights, and, where appropriate, the representation with which he/she is acting, indicating the contents protected by intellectual or industrial property rights, and their location on the Web Site, accrediting, if possible, the ownership of such intellectual or industrial property rights, assuming responsibility for the truthfulness of what is stated in the communication made.

The legitimacy of the intellectual or industrial property rights corresponding to the contents provided by third parties is the exclusive responsibility of the same.

Access to this website does not grant the user any rights or ownership of the intellectual and industrial property rights of the corporate elements or any other content.

– The total or partial reproduction of any of the services or contents of the website, or the establishment of deep-links, IMG or image links, or frames and/or similar, with the Website is not permitted without the prior express written authorisation of ANALCO.

– No false, inaccurate or incorrect statement shall be made about the Web Site or the services or contents thereof. Except for those signs that form part of the link, the web page on which the link is established shall not contain any trademark, trade name, establishment sign, denomination, logo, slogan or other distinctive signs belonging to ANALCO, unless expressly authorised by the latter.

– The establishment of the link shall not imply the existence of any relationship whatsoever between ANALCO and the owner of the web page or portal from which it is made, nor ANALCO’s knowledge and acceptance of the services and content offered on said web page or portal.

– ANALCO shall not be responsible for the contents or services made available to the public on the website or portal from which the hyperlink is made, nor for the information and statements included therein.

5.2. Links to other websites: It is possible that links may be made available to the user on the Website to other websites managed and controlled by third parties, with the sole purpose of facilitating the search for information, content and services on the Internet. ANALCO does not market, direct or control in advance, nor does it make its own the contents, services, information and statements available on these websites, and therefore assumes no liability whatsoever, even indirectly or subsidiarily, for the contents, information, communications, opinions and/or services linked from these websites, opinions and/or services linked from those websites not managed by ANALCO and which are accessible through the Web Site, nor does it guarantee the absence of viruses or other elements therein which may cause alterations to the user’s computer system (hardware and software), documents or files, excluding any liability for damages of any kind caused to the user for this reason.

6.- Non-compliance: If any user breaches the provisions of these terms of use, ANALCO reserves the right to take any legal action that may correspond to it in defence of its legitimate interests, as well as the right to deny or withdraw access to the Web Site, without the need for prior notice, at its own request or at the request of a third party.

7.- Modification of these terms: ANALCO may modify these terms of use at any time, and they shall be duly published on the Website.

8.- Privacy Policy:

8.1. Truthfulness, accuracy and updating of the personal data provided: the user guarantees that the personal data provided are truthful, accurate, complete and that they are also up to date and undertakes to notify any change or modification thereof. In the event that the user provides data of third parties, the user shall be solely responsible for informing and obtaining the consent of these third parties to be entered in the forms for obtaining data from the Website.

8.2. Purpose of the data collected and consent to processing: We hereby inform you that through the different registration forms on the Website, personal data are collected from the user who provides them and are stored in a file owned by ANALCO, duly registered with the Spanish Data Protection Agency, for the sole purpose of:

a) To attend to the user’s requests, consisting of the acquisition by purchase of the products offered on the website, or the contracting of any other service.

a) Maintain the business relationship with the user as well as the management, administration, information, provision and improvement of the same.

b) To send newsletters or new articles from the blog.

c) To send commercial communications of promotions and/or advertising of the website and the children’s products sector by post, email and Whatsapp. The use of the WhatsApp application implies that user data (phone number, status, profile picture, conversations) will be sent to WhatsApp, Inc. servers, which are located in the USA and will therefore be transferred to that country, producing an international transfer of data, which the user expressly and unequivocally authorises by accepting this privacy policy by ticking the box established for this purpose.

Notwithstanding this consent to the international transfer of data, WhatsApp is part of the Facebook group, which participates in and has certified its compliance with the US-EU Privacy Shield framework agreement, having committed to subject all personal information received from EU member countries to the Privacy Shield principles.

Only ANALCO, and the data processors appointed by it, shall have access to the user’s data, and under no circumstances shall this data be assigned, shared, transferred or sold to any third party.

Acceptance of the privacy policy by ticking the acceptance box provided for this purpose shall be understood for all purposes as the user’s express and unequivocal consent to the processing of personal data under the terms set out in this document.

Compliance with the applicable regulations: ANALCO complies with the guidelines of Organic Law 15/1999 of 13 December on the Protection of Personal Data (LOPD), Royal Decree 1720/2007 of 21 December, which approves the Regulations for the development of the said Organic Law (RLOPD) and other applicable regulations in force, ensuring the correct use and processing of the user’s personal data.

Likewise, ANALCO hereby informs that it complies with Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce and shall request the user’s consent to the processing of their personal data for commercial purposes at all times.

Exercise of Access, Rectification, Cancellation and Opposition Rights (ARCO rights): The natural person user who has provided his/her personal data to ANALCO (hereinafter, the interested party or affected party, indistinctly), may exercise his/her ARCO rights free of charge, that is to say, the rights of access, rectification, cancellation and opposition with respect to the data included in its files, which basically consist of the interested party being able to contact ANALCO at any time to find out what data are being processed, to correct errors or modify any inaccurate or incomplete data, as well as to request their deletion if they are inappropriate or excessive or to request that their data not be processed.

Cancellation shall not be applicable when the personal data must be kept for the periods provided for in the contractual relations between the data subject and the entity responsible for the processing.

8.7. Modification of the Privacy Policy: ANALCO reserves the right to modify its Privacy Policy, always in accordance with the applicable regulations or motivated by a legislative, jurisprudential or doctrinal change of the Spanish Data Protection Agency.

Any modification of the Privacy Policy will be published at least ten days prior to its effective application. The use of the Website after such changes shall imply acceptance of the same.

The personal data that you provide through the forms on the Web are processed for the sending of commercial or informative communications through the use of the tool provided by said company, which means that the data entered are transferred to the servers of the aforementioned company, involving an international transfer of data to the United States, which the user expressly consents to by accepting this privacy policy. 9. Applicable law and jurisdiction

These terms of use and privacy policy shall be governed by Spanish law.

In the event of any dispute or controversy relating to the application or interpretation of these terms and policies, the parties shall submit to the Courts and Tribunals that are competent in accordance with the legislation in force.
